Scopema Swivel malfunction fix ideas welcome!

Hello! I installed two Scopema Swivels in my 2020, one, driver side, works great, and the other, passenger side, not so great.
On the passenger side, the top plate is scribing the top of the lower attachment plate, exacerbated when weighted. The sound is definitely annoying, and unacceptable. The seat itself, when holding the headrest displays a fair amount of play, side to side, forward and back. And lastly, while driving, the entire seat rattles quite a bit, especially when I'm trying to enjoy the view!
So, I called the online retailer who said,"this has happened to another customer; that the manufacturer, Scopema, considered this an acceptable condition; that this happens periodically; and would not warranty the swivel."
Has anyone remedied this for themselves?
Any ideas would be much appreciated.

I wedged a wrench under the latch and bent it upwards. Worked like a charm!

Mine are also not working well, at all. So much wobble and squeak.

I have Alpines. No squeaks. But when I adjust the seat forward and back the adjuster rubs the swivel. Don’t think there is much I can do about it looking at the design of the adjustment lever.
